Terms of Service
Effective date: October 13, 2026
These terms apply when you use the ACME Landscaping & Lawncare (“ACME,” “we,” “us”) website at acmelandscapingmaine.com, our online customer portal, or the Acme Landscaping mobile app (together, the “Services”). By using the Services you agree to these terms. If you don't agree, please don't use them. Our Privacy Policy explains how we handle your information.
Your account
- Accounts are created by our staff for our customers and crew members. There is no public sign-up. If we give you a temporary password, you may be asked to choose your own when you first sign in.
- Keep your password private and don't share your account. You're responsible for what happens under your account, so tell us right away at info@acmelandscapingmaine.com if you think someone else has used it.
- Please keep your contact details up to date so we can reach you about your service.
- We may suspend or close an account that is misused, or when you are no longer a customer or crew member. You can ask us to close your account at any time; see how to request account deletion.
Quotes and service requests
- Sending a quote request through our website doesn't create an agreement. We'll follow up to confirm what you need and the price.
- Customers can request extra services through the portal or app. When we price a request and you accept that price, you agree to pay it for that service.
- Visit dates are our best plan and can move because of weather, ground conditions or other things outside our control. We'll reschedule affected visits as soon as reasonably practical.
Service contracts
Recurring work, such as a season of mowing or snow removal, may be covered by a service contract that we send you through the portal or app. Each contract shows its own services, term, payment schedule and terms, including billing, late payment, cancellation, weather delays and how disputes are handled.
- Typing your name and checking the agreement box when you accept a contract is your electronic signature, and it is as binding as signing on paper.
- If your service contract says something different from these terms, the contract wins for the work it covers.
Invoices and online payments
- You can pay invoices online by card. Payments are processed by Stripe on its secure checkout page, and Stripe's own terms apply to the payment. We don't see or store your full card number.
- Some invoice emails include a “Pay invoice” link that works without signing in. Anyone with that link can see the invoice (its items and total) and pay it, so please don't forward it to people you don't want to see it. These links expire.
- Payment is due by the date on the invoice or as set out in your service contract. If you think an invoice is wrong, contact us before the due date and we'll look into it.
Photos, notes and messages you send us
You keep ownership of the photos, notes and messages you add. You give us permission to store, use and share them as needed to provide our services (for example, showing your photo to the crew doing the work). Only send content you have the right to share, and don't include other people's private information.
Acceptable use
When using the Services, please don't:
- try to access accounts, data or parts of our systems you aren't authorized to use;
- interfere with, overload or try to break the Services, or use automated tools to scrape or copy them;
- reverse-engineer the app, except where the law allows it;
- send messages or upload content that is unlawful, abusive, threatening or misleading;
- give false information about yourself or a property, or pretend to be someone else;
- use the Services for anything other than dealing with us about landscaping and lawn care.
Our website and app
The Services, including our name, logo, text and images, belong to ACME or the people who license them to us. We give you a personal, non-transferable permission to use the Services to deal with us; it ends when your account is closed or if you break these terms. If you downloaded the app from the Apple App Store or Google Play, their terms also apply to your download and use of the app, and Apple and Google aren't responsible for the app or its support.
We may change, pause or stop parts of the Services at any time, and we can't promise they will always be available or free of errors.
Disclaimers
The website, portal and app are provided “as is” and “as available.” To the extent the law allows, we make no warranties about them beyond what these terms say. Schedules, estimates and other information shown in them are our best information at the time and may change. This section is about the website, portal and app; it doesn't reduce any commitment in your service contract or any right you have under Maine law for the work we do on your property.
Limitation of liability
To the extent the law allows, ACME is not liable for indirect, incidental or consequential losses (such as lost data or lost profits) arising from your use of the website, portal or app. For any other claim about your use of the website, portal or app, our total liability is limited to the amount you paid us for the service the claim relates to in the 12 months before the claim, or $100 if you haven't paid us anything. Nothing in these terms limits liability that can't be limited by law.
Changes to these terms
We may update these terms from time to time. We'll post the new version on this page and change the effective date at the top. If you keep using the Services after a change, the updated terms apply. Changes won't alter a service contract you've already signed.
Governing law and disputes
These terms are governed by the laws of the State of Maine, USA, without regard to its conflict-of-law rules. If you have a problem, please contact us first; most issues can be sorted out with a conversation. Disputes about work covered by a service contract are handled as that contract describes. Any other dispute about these terms or the Services will be decided by the state or federal courts located in Maine.
